VIII. Buyer's Withdrawal from the Purchase Contract Without Giving a Reason
Extended Return Period - BEYOND WHAT THE LAW REQUIRES
The statutory period for withdrawal from the contract is 14 days. We offer you an extended period of 30 days from receipt of the goods, because we want you to have enough time to decide.
Free Return of Goods (Assistance Service)
Within 15 days of receipt, you can return the goods free of charge through our assistance service. Simply contact us and we will send you a shipping label. If you do not use this service, you may return the goods by any method, but you bear the shipping costs.
Right to withdraw from the contract under Slovak Act No. 108/2024 Z. z. on Consumer Protection
8.1. The consumer is entitled to withdraw from a contract concluded at a distance or off the Seller's business premises within 14 days from the day of receipt of the goods or of concluding a service contract, in accordance with Slovak Act No. 108/2024 Z. z.
8.1.1. The goods are deemed to have been received by the consumer at the moment when the consumer, or a third party designated by them other than the carrier, takes possession of all parts of the ordered goods, or where:
- a) goods ordered in a single order are delivered separately, at the moment of receipt of the goods delivered last,
- b) goods consisting of several parts or pieces are delivered, at the moment of receipt of the last part or the last piece,
- c) goods are delivered repeatedly over a defined period, at the moment of receipt of the first goods delivered.
8.1.2. If the Seller provides the statutory information about the right of withdrawal subsequently, the withdrawal period is extended in accordance with Slovak Act No. 108/2024 Z. z. (The Seller provides this information on the website and in the order confirmation).
8.1.3. The consumer may withdraw from a contract for the delivery of goods even before the withdrawal period begins to run.
8.2. The consumer is obliged, no later than 14 days from the day of withdrawal from the contract, to send the goods back or hand them over to the Seller or to a person authorised by the Seller to receive the goods. The period is considered met if the goods were handed over for shipment no later than on the last day of the period.
8.3. The consumer may exercise withdrawal from the contract in writing, by email to info@nobamo.eu, or through the online form at /odstupenie-od-zmluvy. The Seller recommends including the order number, contact details, and the account number for the refund of payment.
8.4. Withdrawal from the contract also cancels, from the beginning, any supplementary contract related to the contract from which the consumer withdrew.
8.5. After withdrawal from the contract, the contracting parties are obliged to return to each other the performances provided. The consumer is liable only for the decrease in the value of the goods resulting from handling the goods beyond what is necessary to ascertain the nature and properties of the goods.
8.6. For withdrawal from the contract without giving a reason, the consumer may use the withdrawal from purchase contract form. This form is freely available on the Seller's Website and in the "Downloads" section (PDF).
8.7. If the consumer withdraws from the contract, they bear the costs of returning the goods to the Seller, unless they use the free assistance service according to the introductory notice of this section.
8.8. The Seller is obliged, no later than 14 days from the day of receipt of the notice of withdrawal from the contract, to return to the consumer all payments which it received from them under the contract or in connection with it, including the costs of transport, delivery, and postage and other costs and fees. The Seller may withhold the refund of payments until the goods are delivered to it or until the consumer proves that the goods have been sent back.
8.9. If the consumer expressly chose a delivery method for the goods other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse the additional costs incurred by the consumer as a result of this choice.
8.10. Non-acceptance of the shipment
Non-acceptance of the shipment by the buyer, without the buyer having clearly notified withdrawal from the contract beforehand or at the latest upon delivery, is not considered a valid withdrawal from the contract.
If the buyer does not accept the shipment, the Seller is entitled to demand from the buyer reimbursement of the reasonably incurred and demonstrable costs that the Seller incurred in connection with the unsuccessful delivery and return of the shipment (in particular the costs of transport/delivery and return delivery, or a cash-on-delivery fee, if it was charged by the carrier).
The Seller will send the buyer an email request for payment specifying these costs. The buyer is obliged to pay these costs within 14 days of receipt of the request.
8.11. A buyer who purchases as part of their business activities may withdraw from the purchase contract only in accordance with the provisions of Slovak Act No. 513/1991 Zb., the Commercial Code. Such a buyer is not entitled to the right to withdraw from the contract without giving a reason within the 14-day period.
8.12. If the consumer requested the provision of a service or digital content before the expiry of the withdrawal period, they are obliged to pay a proportionate part of the price for the performance actually provided in accordance with the rules of Slovak Act No. 108/2024 Z. z. The Seller must have the consumer's express consent and the instruction on the loss of the right to withdraw in the case of digital content not delivered on a tangible medium.
8.13. From 19 June 2026, the consumer may also exercise the right to withdraw from the contract online on the Seller's Website, by clicking on the link "withdraw from contract here". If the consumer uses this option, the trader shall, without undue delay, provide the consumer on a durable medium by email with a confirmation of receipt of the withdrawal from the contract, including its content and the date and time of its dispatch.
IX. When Withdrawal from Contract is Not Possible
The right to withdraw from the contract pursuant to Slovak Act No. 108/2024 Z. z. does not apply to goods and services where the law expressly excludes it.
The consumer cannot withdraw from a contract the subject of which is:
- a) provision of a service, if its provision has started with the express consent of the consumer and they were properly informed that by complete provision of the service they lose the right to withdraw,

- h) performance of urgent repairs or maintenance expressly requested by the consumer from the Seller; this does not apply to service contracts and contracts for the sale of goods other than spare parts needed to perform the repair or maintenance, if they were concluded during the Seller's visit to the consumer and the consumer did not order these services or goods in advance,
- i) sale of audio recordings, video recordings, audiovisual recordings or computer software sold in protective packaging if the consumer has opened this packaging,
- j) sale of periodicals with the exception of sale based on a subscription agreement and sale of books not delivered in protective packaging,

- l) provision of electronic content other than on a tangible medium, if its provision has started with the express consent of the consumer and the consumer has declared that they were properly informed that by expressing this consent they lose the right to withdraw from the contract.
X. Alternative Dispute Resolution
10.1. If the consumer is not satisfied with the way the Seller handled their complaint or believes that the Seller has violated their rights, they have the right to contact the Seller with a request for remedy.
10.1.1. If the Seller responds to the request for remedy negatively or fails to respond to it within 30 days from the day it was sent, the consumer has the right to submit a proposal to initiate alternative dispute resolution to an alternative dispute resolution entity pursuant to point 10.2. If the Seller responded negatively, the Seller also informs the consumer of the relevant alternative dispute resolution entities.
10.2. The relevant entity for alternative resolution of consumer disputes with the Seller is:
- Slovak Trade Inspection (contact: www.soi.sk), or
- another relevant authorized legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at www.mhsr.sk).
10.3. The EU platform for online dispute resolution (ODR/RSO) was terminated by EU decision and is no longer available. Therefore, submit the ADR proposal directly to the entity pursuant to point 10.2 through their form or the contacts given in the list maintained by the Ministry of Economy of the Slovak Republic.
10.4. Alternative dispute resolution may only be used by a Buyer who acts as a consumer when concluding and performing the contract.
ADR fee: Alternative dispute resolution by alternative dispute resolution bodies (e.g. the Slovak Trade Inspection) is free of charge. An authorized legal entity registered in the list maintained by the Ministry of Economy of the Slovak Republic may require the consumer to pay a fee for initiating alternative dispute resolution up to a maximum of €5 including VAT. The alternative dispute resolution entity may reject a proposal if the quantifiable value of the dispute does not exceed €20.
XI. Supervisory Authority
11.1. The relevant authority exercising supervision over legality in the area of consumer protection is:
Slovenská obchodná inšpekcia (SOI)
Inšpektorát SOI pre Žilinský kraj

11.2. The Buyer may also address complaints or suggestions directly to the Seller at the address stated in point 1.1.1. of these GTC. The Seller also recommends that Buyers address complaints and suggestions (to expedite processing) to the Seller's email address: info@nobamo.eu
Any complaint or suggestion will be assessed by the Seller and resolved within 10 business days of its receipt. The Seller will inform the Buyer about its resolution in the same form in which the Buyer delivered the complaint or suggestion to the Seller.
XII. Supplementary Provisions
12.1. The consumer is entitled to refuse to return goods acquired under a contract concluded during a sales promotion or in connection with it to the Seller until the Seller returns to the consumer the paid price or advance payment for goods or services according to the rules of Slovak Act No. 108/2024 Z. z. on Consumer Protection.
A sales promotion is an event organized based on an invitation, other invitation or information addressed to the consumer, the subject of which is mainly the sale of goods or provision of services and during which or within 15 business days after which a contract is concluded with the consumer.
12.2. Alcoholic Beverages and Tobacco Products
The Seller will not conclude a purchase contract or carry out the sale, mediation, or delivery of alcoholic beverages/products, tobacco products and other products to persons (Buyers) who at the time of concluding the purchase contract have not reached the age of 18, and whose sale to persons under 18 is prohibited, in accordance with the valid and effective legal regulations of the Slovak Republic.
Following the above, the Seller will verify that the Buyer has reached the age of 18 by checking the age through the Buyer's identity document (ID card or passport) when handing over the order to the Buyer. If the Buyer has not reached the age of 18, or if the Buyer does not prove or refuses to prove their age, the Seller will not hand over the order to the Buyer and the purchase contract will be terminated.
XIII. Information on Codes of Conduct
13.1. Pursuant to the information obligation under Slovak Act No. 108/2024 Z. z., the Seller informs consumers that there are no special relevant codes of conduct that the Seller has committed to comply with.
A code of conduct means an agreement or set of rules that define the conduct of a Seller who has committed to comply with this code of conduct in relation to one or more specific commercial practices or business sectors, if these are not established by law or other legal regulation or measure of a public administration body, which the Seller has committed to comply with, and the manner in which the consumer can become acquainted with them or obtain their wording.
XIV. Final Provisions
14.1. The Seller reserves the right to amend the General Terms and Conditions. The obligation to give written notice of a change to the General Terms and Conditions is fulfilled by placing it on the Seller's Website.
In the event of a change to the General Terms and Conditions, the relationship between the Buyer and the Seller shall be governed by the General Terms and Conditions valid and effective at the time of conclusion of the Purchase Contract, until the moment of its termination.
14.2. The Seller's Complaints Policy, which sets out in more detail the liability for defects and the procedure for filing a complaint, forms an integral part of these General Terms and Conditions. The Personal Data Protection Principles and Instructions are published on the Seller's Website. Both the Complaints Policy and the Personal Data Protection Principles and Instructions are published on the domain of the Seller's Website.
14.3. These General Terms and Conditions become valid and effective upon their publication on the Seller's Website on 12.10.2026.
